In a prior post, we reported about the Stryker Orthopedics recall for their artificial hip implant models – Rejuvenate and ABG II. Both of these implants were recalled because if they came in contact with internal pieces they could release heavy metals into the surrounding tissue and bloodstream and result in the ultimate failure of the hip implant.
On November 3, 2014, a verdict against Stryker Corporation was announced. It stated that patients who required revision surgery to remove and replace the Rejuvenate or ABG II hip systems by November 3, 2014, were entitled to a base payment of $300,000. This base payment would be subject to certain deductions.
Some patients may be eligible for more than the base award if they experienced infections or other medical complications as a result of the revision surgery. Some examples of these complications include but are not limited to, osteotomies during revision, re-revisions or other post-revision surgeries. Stryker’s liability is not capped. It is expected that the total amount of payments under the settlement will far exceed $1 billion dollars.
March 2, 2015 DEADLINE
If you or someone you loved has suffered after receiving a Stryker Rejuvenate or ABG II hip systems and required revision surgery before November 3, 2014, you are entitled to compensation. The deadline to submit your claim for compensation is quickly approaching. Paperwork must be filed by March 2, 2015. Important Notice for Stryker Hip Recall Patients Not Covered Under Current Settlement
Patients with Stryker Rejuvenate or ABG II hip systems that fail and require revision surgery after November 3, 2014, are not covered under the first phase of the settlement but will retain their rights to pursue future claims for compensation against Stryker.
