Florida shortened the deadline to file most injury lawsuits from four years to two years for accidents on or after March 24, 2023 (HB 837, amending Fla. Stat. § 95.11). Accidents before that date still carry the four-year deadline.

Where Miami-Dade County crashes happen

The collisions concentrate on the Palmetto Expressway, I-95 through downtown, the Dolphin, and US-1 through Brickell, and the serious ones route to Ryder Trauma Center at Jackson Memorial. Multi-vehicle wrecks on those roads create a fault argument among several insurers at once, each with a reason to point at somebody else, which is a very different negotiation from a two-car crash on a surface street.

The other Miami-Dade pattern is coverage. Florida does not require a driver to carry bodily injury liability at all, and in this county the practical consequence is that uninsured motorist coverage is frequently the largest policy in the case. We read the declarations page before anything else, because it often decides what the claim can realistically be worth.

Which court will my Miami-Dade County injury case be filed in?

Most Miami-Dade County personal injury suits are filed in the Eleventh Judicial Circuit at the Miami-Dade County Courthouse. Claims under $50,000 are heard in county court, and larger claims go to circuit court.

How long do I have to file an injury lawsuit in Florida?

Two years from the date of the accident, if it happened on or after March 24, 2023. Accidents before that date carry the older four-year deadline. Claims against a government entity have their own shorter notice requirements.
