West Palm Beach Personal Injury Lawyer

Palm Beach County has one of the oldest populations in the state, and that single fact shapes more injury claims here than the road layout does. The argument you will meet is not usually about who caused the crash. It is that your injuries were already there. Our office is at 2101 Vista Parkway, and a case arising here is filed in the Fifteenth Judicial Circuit in downtown West Palm Beach. Call 833-370-8692 and speak to a lawyer about what happened. The consultation is free and you pay nothing unless we win.

Deadline changed

Florida shortened the deadline to file most injury lawsuits from four years to two years for accidents on or after March 24, 2023 (HB 837, amending Fla. Stat. § 95.11). Accidents before that date still carry the four-year deadline.

Where Palm Beach County crashes happen

The degenerative defense is run in this county more than anywhere else we practice. An insurer points at imaging showing wear that predates the collision and argues the crash changed nothing. It is answerable, and the answer is documentary: prior imaging and records establishing a baseline, and evidence of what you could do before against what you can do now. Florida law compensates the aggravation of a pre-existing condition, and insurers rely heavily on that not being widely understood.

Geographically the serious cases bunch up on I-95 and the Okeechobee and Southern Boulevard corridors that feed it, with major trauma going to St. Mary’s Medical Center. Cases are filed in the Fifteenth Judicial Circuit at the main courthouse in downtown West Palm Beach, which is where the north county matters are heard.

The two claim types that come out of those roads most often are West Palm Beach car accident claims and West Palm Beach slip and fall claims. Everything else we handle in Palm Beach County is listed above.

What to do in the first week

  • Get evaluated, even if you felt fine at the scene. Gaps in treatment get used against you.
  • Report the crash to your own insurer, but do not give the other side a recorded statement.
  • Photograph the vehicles, the scene, and your injuries while they are visible.
  • See a doctor within 14 days of a crash, or your own coverage pays nothing at all.

Questions

West Palm Beach questions we get

The insurer says my MRI shows problems that predate the crash. Is my claim finished?

No, and this is the most common argument in Palm Beach County. Nearly every adult has some degenerative change visible on imaging, which is exactly why the argument gets made so often. Florida compensates the aggravation of a pre-existing condition. Prior records and a clear before-and-after picture of your function are what answer it.

Where is your West Palm Beach office?

2101 Vista Parkway, Suite 4500, West Palm Beach, FL 33411. Consultations are free, and we can come to you if you cannot travel.

Which court will my Palm Beach County injury case be filed in?

Most Palm Beach County personal injury suits are filed in the Fifteenth Judicial Circuit in downtown West Palm Beach. Claims under $50,000 are heard in county court, and larger claims go to circuit court.

How long do I have to file an injury lawsuit in Florida?

Two years from the date of the accident, if it happened on or after March 24, 2023. Accidents before that date carry the older four-year deadline. Claims against a government entity have their own shorter notice requirements.
